CA 2006 imposed a requirement for all companies to show the company registration number, registered office and country of registration on the company websites, order forms and letters, including all emails sent on behalf of the company. I understand the company can be fined up to £1000 for not complying with this regulation, which was effective from 1 Jan 2007.
Who imposes that fine? Have any companies been fined so far, and how likely is it for a company to be fined for non-compliance?

Although sections 82 to 85 don't commence till Oct 09, they basically repeat what's in the 85 Act and an EC directive. One of our clients has received a letter from the "Appeals & Breaches" section at Companies House about a minor infringement that came to the attention of the Registrar and they sought confirmation from the company that both the breach had been corrected and that the web site complied with the rules. It seems that any fine would have to be imposed by the Court so one would have notice before that happened, and an opportunity to correct the situation.

It occurs as to how many companies will genuinely comply with showing their details on their websites, emails, etc especially ones that don't rely on electronic communications that much for business. I assume though that if fines for non-compliance are enforced, it'll whip companies into shape pretty quick!

The website requirement is already in force from 01.01.07 in the form of Statutory Instrument 2006 No. 3429. S. 82-85 of CA2006 commence 01.10.08 and simply give a general outline of the requirement and penalties.

Legislation that came into effect from 1 January 2007 has implications for all businesses and companies which have a website. In an update to the Companies Act 1985 the following information must be displayed on websites, order forms and any other electronic documents which could be construed as “business letters”:

1.Company registration number
2.Place of registration
3.Registered office address

For websites, the information could be displayed on the “About Us” or “Contact Us” or “Legal Info” page - details do not have to be displayed on every page.
Non-compliance with the statute could result in a fine.
